Is Senator Van Hollen violating the Logan Act?

That law makes it a crime with a potential prison sentence of up to three years for “any citizen” of the U.S., acting without government authority, to “directly or indirectly correspond” with any foreign government or foreign official with the aim of influencing their dealings on any controversies with the U.S. government, or of defeating a U.S. government action.

What I find amazing is that the man is a criminal. Broken federal law and of course isn't a US citizen. But a US Senator is going to a foreign country trying to bring this criminal back.
